that 'new' should do?
Hardly any modern C++ code (including the standard C++ library) will
work properly if new does not throw an exception on failure to
allocate memory.
It seems best to fix/replace the broken compiler.

if the data is not supposed to be gamma (or log)
encoded. There are many contributing factors to color space beyond
mere gamma encoding such as the primary colors, and the relative
strengths of those primary colors.

industry standard.
A more exotic approach is to represent the rate as a frame delay
instead. This allows for frame playback at varying rates, with the
possibility to hold one frame for a long time.
