I've received a (final?) response from Direccion General de la Policía
(DGP) about a question I sent them about the posibility of
dual-licensing DNIe code under LGPL for inclusion into OpenSC:

En cuanto a sus observaciones sobre la posibilidad de incluir el código
del módulo pkcs11 del DNIe en su proyecto, sentimos que la modificación
en las políticas de OpenSC en cuanto a la mecanismos de inclusión e
invocación suponga la imposibilidad de incorporar el código publicado al
mainstream de OpenSC.

Efectivamente, el tipo de licencia elegido para el código fuente del
módulo pkcs11 del DNIe es incompatible con la inserción de dicho código
en un producto bajo licencia LGPL. A este respecto le comunicamos que se
ha elegido el tipo de licencia GPLv3, compatible con la EUPL, en base al
contenido del R.D. 4/2010 por el que se estimula la reutilización y
transferencia de la tecnología en los términos descritos en el marco
europeo de interoperabilidad. La finalidad última de la liberación del
código es que sirva de estímulo y base de conocimiento a los
desarrolladores interesados en esta tecnología. Sentimos que esta
postura de máxima difusión, largamente esperada por distintas
comunidades de desarrolladores, afecte negativamente a su proyecto.

On your notes about the possibility to include DNIe module into your
project, we apologize that modifications of OpenSC's politics on adding
code into their project becomes the imposibility of adding published
code into OpenSC mainstream
Efectively, chosen licence for DNIe code poblishing is incompatible with
the insertion of that code into a project licensed under LGPL
About this election, we can tell you that chosen license GPLv3 is
compatible with EUPL on R.D 4/2010 on reusing and technology transfer
stimulus for eurpean interoperability mechanisms
The intention on publishing this code is to serve as knowledge base
for developers interested in this technology. We're sorry that this
politics of maximum aperture, largelly expected for several comunities
of developers will affect negativelly to your project

In short: DGP says that is in peace with law, in compliant with 
european directives of interoperability, and apologizes for being
stealing OpenSC software during two years, to finally resulting on
no possible technology return to OpenSC project

Martin: I'll send you last updated patches to DGP's DNIe code 
(functional and synced to last svn tree), and look for some people
to start an independent and really free development for a LGPL'd DNIe
code to become part of OpenSC.
