Uhm ... sun is a company ;) - Sun's JDKs 1.5.0 and 1.6.0 are available licensed under the DLJ, which is not open source but re-distribution-friendly - Version 1.7.0 will be available as OSS later this year ... right now, parts of it are alredy available: The Virtual Machine and the Compiler. The
