On recent issues of this list, a question was raised about permission to use
intellectual property.

Orchid society newsletter Editors might be interested to know that Section
107 of the 1976 United States Copyright Act addresses the use of text and
graphics from a copyrighted work by non-profit organizations. The gist of
the section is: portions of a copyrighted work MAY be reproduced for
educational and non-profit use, without obtaining permission. See also page
4, the 4th paragraph from the bottom which mentions the use of graphics.

Chapter 1 of the Copyright Law is 78 pages in length, but Section 107 is
about one-third of a page in length. It might be wise for newsletter Editors
to keep a copy of Section 107 on file.

The above URL is the Copyright homepage. Under the heading, About Copyright,
click on Copyright Basics. After that page loads, scroll down to the blue
link for Section 107 of the 1976 Copyright Act.

With reference to comments made on this list about the American Orchid
Society digitizing back issues of the Bulletin/Orchids: it seems unlikely
that there would be sufficient, savvy AOS volunteers to accomplish such a
feat. The AOS might consider contacting Google and partnering with Google.
As many readers of this list surely know, Google will be scanning books from
the New York public library and libraries at Harvard, Stanford, Michigan and
Oxford, and making them available online.
