Is the list being pulled from the top level masterpage folder? Or you
referencing it later on down in the tree of sites?

I've tried to enforce all sites to pull from the master gallery which is why I
wound up adding the MWS master there.
It all seems a little painful though. My main gripe, though, i
to see if this is fixed in SP2.
