I can confirm that the fencing script that ships with DRBD 8.3.7 can cope with
DC election timeouts (even with default values in my case).

A bug would be preferable (things are too easily lost on mailing lists).
I dont think your constraint will work as-is if there are more than 2
nodes, but it also shouldn't be causing the instances to stop.
