A 1998 lawsuit brought by activist Marc Kasky against Nike Inc has been
settled with Nike paying $1.5 million to the Fair Labour Association, a
workplace monitoring group. The lawsuit was in response to a 1996-97
Nike publicity campaign defending sweatshop allegations against its
Asian factories. The settlement was an unexpected end to a case that
many thought would resolve the constitutional issue of what exactly
constitutes commercial speech.
