Yup, but that doesn't mean it's not free, in fact copyright is needed to
license something under the gpl. I'd think it's free as clarlooks is
based on bluecurve, although I haven't read its license

could ship some by default like "Human (Clearlooks-Human and Humility)",
"Gnome Default" (clearlooks and gnome default icons),

Well, I dunno anything about themeing gtk, but I believe you can mix
several theme engines in the same theme, so you could put pixmap
scrollbars and make them look however you want them to look.
