Confirmed in 12.04.2
Fixed in GPSD in Aug 2009, here is the original bug report in Debian
bugtracker http://bugs.debian.org/cgi-bin/bugreport.cgi?bug=542384
Gpsd developers added compile time option (!?) to set fallback gpsd
group when device from command line is unavailable when gpsd starts.
IMO
I also tested other kernels below:
linux-image-3.5.7-03050715-generic_3.5.7-03050715.201306210530_amd64.deb
linux-image-3.6.0-030600-generic_3.6.0-030600.201209302035_amd64.deb
linux-image-3.6.11-030611-generic_3.6.11-030611.201212171335_amd64.deb
linux-image-3.7.0-030700-generic_3.7.0-030700.20121
On 2013-02 Mr James Paige patched this so it would work for newer
kernels. It did worked up to 3.9.

I have this problem as well and I know where it comes from along with
three possible workarounds.
I don't have the afsql module enabled in /etc/syslog-ng/modules.conf,
nor do I have syslog-ng-sql installed (only libsyslog-ng and syslog-ng-
core). However, reading modules.conf I figured that afsql
the lfe volume control is for the orange jack and this has no effect on
the subwoofer if you are using creative analog 4.1 speakers
