The menu.lst from grub wasn't replaced by the dist-upgrade and as a result I
was running 9.10 with kernel from 9.04
Once I upgraded menu.lst the problem got fixed

You need to install the correct linux-headers-... package.
The command uname -r prints the version of the currently running kernel.

In my humble opinion this was produced because the Ubuntu didn't upgrade
correctly the kernel itslef. I don't have any customized kernel but it
hadn't been well upgraded.

Hi!
I noticed the same this morning. I've tried to download the kernel sources
with aptitude but they are not present.
The upgrade didn't force the installation of the 2.6.31; so I'm willing to
force it, but not sure how.
I'll investigate this afternoon since I didn't have much time.
