I'd recommend using a newer version of syslog-ng. You can find binaries

I did a fresh install of 12.04, installed syslog-ng, updated the
machine, but I could not reproduce this problem. Permissions were
always correct and logs collected. It does not seem to be a syslog-ng
package bug.

9.10 is not a supported Ubuntu version any more. syslog-ng in recent Ubuntu
releases is not affected by this problem.
If you want to use the latest syslog-ng release (3.3), please use packages from
http://asylum.madhouse-project.org/projects/debian/ which fixes some bugs even
for the syslog-ng v
Tested on Ubuntu 11.10 and the problem is fixed.

Is it still problematic to run syslog-ng under vserver/openvz? If yes,
please test packages from http://asylum.madhouse-
project.org/projects/debian/ which contain the latest syslog-ng release
(3.3), if it solves the problem!

Tested on Ubuntu 11.10: syslog-ng 3.3 packages from one of the syslog-ng
developers work fine, without the warning message.
