Communications Inc. AR9485 Wireless Network Adapter (rev 01) and are
still seeing this... Tested with upstream kernel 3.4.3, 3.5-rc3, 3.5-rc4

Tested kernel Linux 3.4.1-030401 (sorry - I didn't see your link to
3.5-rc1 until after I downloaded 3.4.1). The issue is fixed with this
kernel. I rebooted with 3.2.0.24 and confirmed the issue is there with
that kernel.
This is good news for me - except that I cannot use the nvidia
proprietary

Would it be possible for you to test the latest upstream kernel? Refer
to https://wiki.ubuntu.com/KernelMainlineBuilds . Please test the latest
v3.4kernel[1] (Not a kernel in the daily directory) and install both the
linux-image and linux-image-extra .deb packages.
