yes this is still an issue on 8.10
with a new user account, emerald does shade rather than maximises/restores by
default

this can be configured with emerald-theme-manager => Emerald settings =>
Titlebar Double-Click Action
- Shadow
- Maximize/Restore
- Minimize
The default settings for Ubuntu are in /usr/share/emerald/settings.ini
