Was able to 'solve' the issue through
sudo apt-get purge linux-image-6.5.0-35-generic
reboot # into the 6.5.0-28-generic kernel
sudo apt update;sudo apt upgrade
reboot # into the 6.5.0-35-generic kernel

Tried as well in (initramfs) to load the kernel module for lvm and lvm
vgchange -ay but this does nothing in (initramfs) making the system also
not recoverable when starting with the 6.5.0-35-generic kernel
