What about letting System->Preferences->Screen Resolution run
nividia-settings when the closed nvidia driver is detected?
gnome-display-properties could be made a wrapper script to choose between them,
e.g. by querying for the NV-CONTROL extension.

Those icons definitely cannot be distributed (unless there is new
negotiation between Ubuntu and nVidia). A new icon should be created
for this purpose, and licensed to allow distribution.
