This is no longer a problem for me, tcpdump works as expected using ubuntu 9.04
with kernel
2.6.28-14-generic #47-Ubuntu SMP Sat Jul 25 00:28:35 UTC 2009
and
tcpdump version 3.9.8
libpcap version 1.0.0
