Right managed to sort the problem, after 3 years of trying.
My laptop only has one hard drive but enabling the raid option in the
bios, manages to fix the problem so i'm marking as solved.

just upgraded to grub2 beta 4 and the problem still persists.
But whilst running the live-cd the drive is accessible and appear to
work fine. Any ideas?

Once grub was installed the CD drive is no longer recognised in ubuntu /
