Also note that the problem is definately not the machine or card is I
have no problems in windows using the drivers on the intel website
(drivers only install)

Make sure you don't have the kill switch on the side of your machine cut on.
That could be your issue..if the rfkill switch is on then wireless isn't going
to work.
