ok it was a cahe prob with my broswer the comment out the stuff in
/etc/apache2/mods-available/php5.conf still works

libapache2-mod-php5 is no longer working correctly on
this can be circumvented when setting
short_tags = On
within the php.ini used by the apache moduel (usually
/etc/php5/apache2/php.ini).
PHP-Module works only, if this directive is enabled, no matter if your code (or
the code of the apps you're using) actually uses short tags.

I've the same problem with cherokee and apache2.
I've try to uninstall and purge all apache2 and php packages... that doesn't
solve the problem.
