Yes but the patch has not yet been delivered with ubuntu updates.
I fixed it for me by installing a newer kernel vom the ubuntu mainline ppa:
http://kernel.ubuntu.com/~kernel-ppa/mainline/v2.6.38.5-natty/

I have the same problem. Once I see kernel panic. Then I try update ath9k
driver from daily sources. After this I saw kernel oops.
