I haven't tried Gutsy alpha but I don't think I saw the bug since I upgraded to
/ reinstalled Feisty.
Maybe it has been fixed in Gnome 2.18 ?

Nothing like that. I only have one partition on my harddisk (apart from
the swap) and it is ext3 I think (the default filesystem used by
Ubuntu).

Marking uncorfirmed, that works fine for me. Do you have files on a
partition different of your user directory to the trash when that
happens? What filesystem do you use?

Yes, the trash is really empty (the folder lists nothing). The only
problem is with the label in the menu.

Thank you for your bug. When that happens if the trash really empty or
is the icon wrong (if you click on the trash does the folder list
anything)?
