There's only one hard disk present in the machine, and is the only one
detected by the BIOS.
Since then I've reinstalled and this went away. But I believe the bug is
real and that grub should intelligently check if the partitions have
changed and update menu.lst accordingly, if possible.

Is /dev/hda the primary hard disk according to your BIOS?

I can confirm I've seen this one on every version of Ubuntu since Dapper and
I'm still seeing this in Feisty 7.04
Attached the current, broken, menu.lst

menu.lst on every kernel update and this would definitely scare new
users.

Please attach your complete /boot/grub/menu.lst if you haven't changed it
manually yet. Take a look at the last modification date of menu.lst by running
ls -l in a terminal to know if it has been changed.
Also attach your /boot/grub/device.map and provide the output of the following

Now I only have hda1-/ ext3 and hda2- swap and every time I update the kernel

My system already had kernel 2.6.19-7-generic download from the repos last
week. Yesterday (december, 04) the same version of kernel was present in the
repos and it was dowloaded by update-manager.
After the installation I checked /boot/grub/menu.lst and noticed
I can't confirm this bug on Feisty up-to-date, with linux-
image-2.6.19-7-generic installed yesterday.
