I think the policy of revealing the thumb got improved in oneiric,

Our scrollbar is resizing very similarly to standard ones. I see the
problem you are noticing but I think we should wait to see how much
relevant it is. As you mention we could easily intervene in the active
region size but for the moment I would wait to get more data. Thanks for
the feedback!

I realised that it's similar to a normal scrollbar (the slider gets
smaller depending on the amount of content) - however on those you can
still click on the track and page down/up without navigating to the
slider. This may be a bug in the way the log file viewer and the
overlay-scrollbars combine.
