this kernel is now EOL and the VIA patch never came.
Ubuntu is not responsible for maintaining external suppliers patches and
it's compatability with the upstream Linux kernel.

This is not a bug within ubuntu.
The patch supplied by VIA to allow this device to work is not compatible
with kernels post Ubuntu 9.10
Via have been informed of this and this should not be progressed until
VIA release an update to the official patch.
