Its seems that the package is not compatible to the natty kernel.
The following actions made it possible to enable tp-smapi-dkms on a Ubuntu
Lucid 10.04 with a backported Natty 2.6.38-13 Kernel

This happens because of changes in kernel 2.6.37, see Bug #673343, this
is fixed in Natty and there are patches available.
It is unlikely that this will be backported to lucid as it only happens
with custom
