Rwanyarare sues Obote

DR. James Rwanyarare, the former Chairman of the Uganda People's Congress Presidential Policy Commission (PPC), last evening took Party President Dr. Milton Obote to court over his sacking.

Rwanyarare, through his lawyers, Byenkya, Kihika & Co. Advocates, filed the civil suit before the High Court in Kampala challenging Obote's creation of the Constitutional Steering Committee (CSC) under Hajji Badru Wegulo.

He said the CSC is inconsistent with the UPC constitution, the Political Parties and Organisations Act (PPOA) and the 1995 Constitution. The CSC replaced the PPC in March.

Obote announced the changes to the fury of UPC officials who have been at the helm in Kampala for almost 20 years.
Rwanyarare's suit was jointly filed with other UPC officials, Mr Thomas Enabu, Salongo Kaweesa Makubuya, Mr Muhamood Mubiru, Mr Nelson Umah Tete and the former party administrator, Mr Kyeyune Ssenyonjo.

Obote has been jointly sued with the newly appointed UPC Secretary General, Mr Peter Walubiri, Wegulo's deputy, Mr Livingstone Okello Okello and Hajji Abubaker Adoko Nekyon.
According to the suit, Rwanyarare and his group want court to declare Obote's actions null and void because the party president had no powers to do so.

Rwanyarare's petition also indicates that "the persons appointed to the newly created posts under the UPC party after registration have no competence to perform any act binding on the UPC, its organs, party officials, assets or staff."

"The UPC party is not directly or vicariously responsible for maintaining, funding, remunerating, or liable for, any of the acts of the persons appointed by the UPC 1st defendant in the manner herein disputed and in anyway contrary to any of the provisions of the registered party constitution," Rwanyarare's petition reads.

Walubiri said last evening that the accused party officials would defend themselves. "Since I am a defendant, I will be able to tell my story once I am served," he told Daily Monitor by telephone.

The UPC lawyer described Rwanyarare's action as diversionary. "James seems not to be working for the party but for some other people. All this is diversionary," Walubiri said.

Rwanyarare, who has been the de facto UPC leader in Kampala for almost 17 years, fell out with Obote in March when the latter replaced him with Wegulo. He and other party officials have unsuccessfully tried to seek an explanation from the party leader exiled in Zambia since 1985.

Obote has kept silent over the issue that seems to be moving to create a big rift among party officials in Kampala. Rwanyarare has publicly warned Obote against manipulating the party's delegates’ conference expected in August.

Rwanyarare, who has also publicly announced that he would contest for the post of party president, says that Obote wants to front for UPC London Bureau Chief Joseph Ocieno and is manipulating the process. Ocieno arrived in the country on April 13 with Obote's son, Mr Jimmy Akena.
Ocieno denied the claims.
