I wouldn't assume gumby is public domain because you think someone else is treating it that way.
I don't think gumby is. Especially after the MickeyMouse extension of copyright


Legally, someone else's infringing doesn't help excuse yours.

Of course practically, there's always the business analysis:

how likely is the IP holder to find out about my use?
how likely are they to come after me?
Do I have anything to lose?

I'm a newish  vlogger and new to the list. I plan to go to vloggercon and live in SF. I can put up a person or two.
