Actually I think it is more a case of contract law than any copyright/
"first sale" issue. In order to get the DVD or stream from Netflix, the
library ( or someone on their behalf) agreed to a set of terms that may
indeed be MORE restrictive than regular copyright rules. First Sale
basically means

bit. We lease American History in Video and it's also very popular. It's a bit
dependent on, I would guess, the depth of your hard copy collection.

We lease streaming videos from Films on Demand and Ambrose Video.
Both vendors allow for the purchase of individual titles, but also provide
“bundles” for sale
(however, I’m more of an individual title kind of gal).
The videos are used regularly, but I wouldn’t call it heavy use.
I think this is kind of what I'm getting at. When libraries buy something,
they have the right to turn around and lend it. But since libraries are
not buying DVDs from Netflix, they don't inherit the right to then lend
them. It's because it's a difference can o' worms that, I'm thinking,
makes
First Sale has to do with commercial property transfer exclusively, I
think. In other words, it has to do with the rights of legal buyers. The
NetFlix transaction is a rental--a temporary "lease"?--and is, I would
imagine, a different can o' worms. But then again, I'm in no way
positive.

We discourage it - cases are labeled "Do not place in bookdrop." But they
aren't penalized when it happens.

We do allow videos to be returned in our book drops (we don't have separate
ones for media) and so far we haven't had any problems.
