I am thinking of getting an IPOD TOUCH and I am wondering if this
issue was ever resolved?

Modern LI batteries have electronics in them to keep the charge from
getting so low as to cause permanent damage. There's no problem with
running a LI battery down that low. The only exception would be if
you'll not be charging the battery for a while, such as days or weeks.

Hello Laura. It's nice to have yet another person with this issue. I mean
to say that it stinks that it having it also,but refreshing to know that
enough people are havering it to let me know that Apples engineering
department will have to come up with a solution sooner rather than later.

battery down that low very often is definitely hard on it, though, I
wouldn't make a habit of it unless I really wanted to buy a new device
before I had to.

I experienced the exact same issue with my first iPod touch 5. Apple
replaced the unit yesterday after an unsuccessful device wipe and software
reinstall. I do not yet know if the replacement device has the battery
issue.
