Hello, Christian, I confirmed this bug and have already fixed it. The fix will be available in development branch after it is properly tested (that is tomorrow I suppose).
If you build Sedna from another (other from development) branch, I can send you a patch for a version you use. That is generally not possible to insert an empty text node to a document (restriction in http://www.w3.org/TR/xpath-datamodel/#TextNode). But for sure it should not even issue an error.
