- traditional role of patents either offensive (leapfrog competitors) or defensive (freedom to operate) - book targeted more at corporates but also a section for non-profits - author advocate proactive management through licensing, acquisition, even sharing - spectrum of possibilities ranging from full exclusion (sword+shield) to open-access (freely available) - 2 primary markets for IP exchange (cross-licensing of patents) & (merchandising/extension of trademarks/copyright) - average patent litigation cost [in US] $3-10M and take 2-3 years Whilst most startups consider IP to be a auxillary function, I'm professionally concerned that this attitude is akin to Doha round of WorldTradeOrg where all the countries made deals on cutting tarrifs whilst ceeding the IP landscape to the US. For example, the recent Anti-Counterfeiting Trade Act has now been signed by 8 countries (incl Australia/NZ). https://www.eff.org/deeplinks/2011/10/acta-signed-8-members-are-we-doomed-yet https://www.eff.org/pages/trans-pacific-partnership-agreement Lessig talked about the role of software architecture in enforcing (sometimes subtle) laws. There is concern by organisations such as EFF that extra-judicial measures are being implemented directly by the executive branch (in this case powers for customs to seize goods that infringe copyright/trademarks) without full discussion by stakeholders. As technology is often a sunrise industry and existing laws tend to be shaped by incumbants, transparency in the rule-making should be a high priority ... especially when it comes to trade in global services such as OpenCloud.
