Dear Friends, I have a purchased a plot measuring 5 cents in a hill station from the then owner of the undivided plot measuring 9.6 cents in 1986. As per the regulations in force I should have applied to the local survey departments-Taluk Surveyor immediately after registration of the document and got a patta. But as I am not aware of the above provision I did not apply till April 2008. After 1989 the remaining portion of the plot measuring 4.6 cents held by the seller was sold to somebody say X and that somebody had sold the same to another Y who is the present owner-cum-neighbour. In 1987 I got the plan approved for a house building by the local municipal administration without sub-division of the original undivided plot as the same was not insisted by them. Now after retirement from the service I thought of applying for sub-division of the plot and patta issued in my name after duly measuring the divided plot for 5 cents standing in my name. The problem started when I proceeded in constructing a compound wall in my boundary. The neighbour Mr.Y started obstructing construction of compound wall stating whatever boundary between my plot and that of Mr.Y as belonging to him. He further contends that whatever building constructed on my portion of the plot has been constructed on his plot meaning that he has ignored the action. He has no ground for arguing/proving whatever he contends over the construction and simply prevents without gaining anything by his action. As I am the party affected I am unable to proceed and I do not know how to proceed in constructing the compound wall. Can anybody highligt me with the procedure to be followed in construction of the compound wall and the legal remedies available.
