Dear Friends,
One of our tenant who is occupying our premises (Commercial Building)since
1.4.2009 onwards not paying service tax.On this matter he gives the reference
of the court case of Home solution Retail India Ltd. vs.Union bank of India
wherein Delhi high Court.It says that mere renting of immovable property for
furtherance of business or commerce by itself cannot be regarded as a taxable
service.
Actually we have already deposit service for 6 months onbehalf of them and now
i am in a delemma to what to do.Please guide me.
