No, there is no downside of using a jack built without libcap. I wasn't sure 
myself and talked to one of jack's devs and he made clear that one *should 
not* use libcap with jack, except when they are running a 2.4 series kernel.
The change in the SlackBuild of jack was therefore not to avoid the problem 
mentioned in this thread, but a bugfix. It will not be returned to its 
original state.
I might rethink this when jack supports libcap also on 2.6 kernels.
