Kevin, I'll just add a little bit to what you've already been told.

These days, most courts have a procedure called "preliminary discovery". Among the types of preliminary discovery is one that helps you overcome the problem that you can't sue a particular person because you don't know his/her/its name. You apply to the court for preliminary discovery against a person you believe will be able to tell you the name of the person you want to sue. I'm most familiar with the procedure in the Federal Court, where I used to work, but I know that the NSW Supreme Court has the same procedure.

If you're thinking of speaking to a solicitor, you should be aware from the outset of the procedure I've mentioned. If you think you might be assisted by reading the rules of, say, the NSW Supreme Court about preliminary discovery, let me know and I'll either send them to you electronically or give you a URL for them.
