Berkaitan dengan situasi di Jerusalem Timur, Dubes Djani menggarisbawahi keprihatinan mendalam Indonesia atas penggalian di wilayah seputar Mesjid Al Aqsa dan mendesak Israel segera menghentikan aktivitas tersebut, menghormati hukum internasional dan resolusi-resolusi Dewan Keamanan PBB terkait, serta membuka akses tempat-tempat suci di kota suci ini. Berkaitan dengan Goldstone Report, Indonesia memberikan arti penting atas laporan Goldstone yang kredibel dan komprehensif. Oleh karena itu sudah tiba waktunya bagi Dewan HAM PBB untuk membahas substansi laporan Goldstone dan rekomendasiya, serta mengambil tindakan nyata terhadap pelanggaran HAM dan hukum humaniter yang terus berlangsung di Jalur Gaza. `'Tidak adanya tindakan nyata justru akan mempertaruhkan kredibilitas Dewan HAM,'' demikian ditegaskan oleh Dubes Djani. Dalam menanggapi laporan periodik Komisaris Tinggi HAM, Ms. Navanethem Pillay, Dubes Djani menyampaikan bahwa Indonesia mendukung laporan KTHAM, khususnya rekomendasi yang meminta Israel menghentikan tindakan dan kebijakan yang selama puluhan tahun telah menimbulkan penderitaan terhadap rakyat Palestina. Dalam kaitan ini Dubes Djani mengutuk kebijakan pengusiran secara paksa, dan perluasan pemukiman yang terus dilakukan oleh Israel. Sejak pembentukan DHAM pada tahun 2006, Indonesia, sebagai anggota Dewan, secara aktif dan konsisten terus mendukung berbagai upaya untuk meningkatkan pemajuan dan perlindungan HAM rakyat Palestina. Sidang Khusus DHAM ini diharapkan akan menghasilkan resolusi yang berisikan tiga bagian, yaitu situasi HAM di wilayah Pendudukan Palestina dan Jerusalem Timur; Laporan Goldstone, dan laporan Komisaris Tinggi HAM mengenai pelanggaran HAM yang dilakukan oleh Israel. DIAN TRIANSYAH DJANI, AMBASSADOR/ PERMANENT REPRESENTATIVE OF INDONESIA AT THE 12TH SPECIAL SESSION OF THE HUMAN RIGHTS COUNCIL - HUMAN RIGHTS SITUATION IN THE OCCUPIED PALESTINIAN TERRITORY AND EAST JERUSALEM Mr. President, I would like to begin by associating my delegation with the statements delivered by the Permanent Representatives of Pakistan and Egypt on behalf of the Organization of the Islamic Conference and the Non-Aligned Movement respectively. Mr. President, Indonesia remains profoundly distressed by the depth of the human rights and humanitarian crisis that continues to permeate in the Occupied Palestinian Territory. The most appalling situation is the Gaza Strip following the Israeli attack of December 2008 and January 2009. My delegation is also disturbed by the clampdown on the flow of food, medicines and materials to the territory, which continues to have a severe impact on the civilian population on the ground. My delegation is of the view that action must be taken immediately, particularly bringing to justice those accused of having violated International Human Rights Law and International Humanitarian Law. Mr. President, Allow me to emphasize that Indonesia places high value on the comprehensive and credible report of the Independent International Fact-Finding Mission headed by Justice Goldstone, which presented an authoritative and accurate picture of what happened in the ground. It is high time that the Council discusses the substance of the report and its recommendations and decides on further steps to be taken, particularly with regard to serious violation of international human rights law and international humanitarian laws which continue to occur in Gaza. It will inevitably strengthen the credibility of the Council, particularly in respect of the continued violation of human rights by the Occupying Power. Mr. President, My delegation also welcomes the first periodic report submitted by the High Commissioner during the previous 12th Session of the Council. The report contains crucial recommendations which need to be seriously and immediately implemented by the Occupying Power in order to halt the indiscriminate collective punishment that it has inflicted on the Palestinians for decades. In this regard, Indonesia condemns the fact that forced evictions, home demolitions, and the expansion of settlements continue unabated. My delegation demands that the Occupying Power cease such practices, which constitute a breach of International Human Rights Law and Humanitarian Law Mr. President, Indonesia also condemns the policy of closures and restrictions imposed on the Palestinians in East Jerusalem, which hinders their free access to Muslim and Christian holy sites, including the Al Aqsa Mosque. Moreover, my delegation is deeply concerned by the ongoing excavation work and activities beneath and around the Al Aqsa Mosque, and demands that Israel as the Occupying Power, immediately ceases these activities and respect international law and relevant UN Security Council resolutions in such a way as to allow Palestinian citizens and worshipers unhindered access to their properties and religious sites. Mr. President, Since its establishment in 2006, the Council has already convened four Special Sessions on this same issue, making today's Session the fifth. There is too much at stake for us should we take the reports for granted. The Council must therefore take serious and meaningful action. In order to achieve this, my delegation calls on all Council members to engage positively and constructively on the draft resolution before us today, and to work and aim for a consensual text. To conclude, Mr. President, Indonesia considers that the continued Israeli illegal policies would hamper efforts for a just, comprehensive and lasting peace in the Middle East and jeopardize the prospects for establishing a sovereign and independent State of Palestine, with East Jerusalem as its capital.
