This may be a case of common property shared by all
and is not unusual in developments of residential subdivisions. You might
question him or another property owner if this is the case for the property on
which the tank sits. Or, you can check with the city/county building department
for a look at the survey plat which usually contains any such covenants as
commonly owned property and rights of way.
