Disclaimer: I'm merely answering a question, I'm not advocating any of the following :-) Legally you can look into such things as false advertising and GPL violations. You can also take a look at the eBay by-laws and see if they break any of them. If you want to get nasty, you can buy copies of the sw and then ask for a full refund, including shipping (so they lose money, and are inconvenienced).
