I think the problem is more certifications. Ok, for WMA and AAC you still have to pay some license fees, too, but at least the ones for MP3 are running out this year... But CE, FCC, WiFi,... that's expensive stuff and it means you either end up with expensive units or you need large volumes.
And there have been a number of kickstarter campaigns that did exactly that and pretty much lead nowhere.
