Well Todd, how long a discussion would you like to have? After all we could go on forever, on who should get what Rights and under what circumstances. The time we ( the members of the list ) have spent on the 1st amendment alone has filled many hours already. I still don't think that this is the form for it. I was responding to what Andrew wrote about what is and is not a Right and how I thought that Americans in general don't understand what their Rights are and are not because they have *not* taken the time to find out for them selves, but, just relying on what politicians or others have told them. So I will give you an example of what I'm talking about, and the reason I gave the response I did.
A Right, is something that is generally considered to be protected by law. Emergency health services is a Right ( at least in many places ), but, having a wart removed is a privilege, yet, many politicians, promise, that they would make it a right with the words "universal health care for every one" if I'm elected. What makes the difference? Simple the wart is not life threatening, that is why having it removed is a privilege not a Right. For example: The 1st amendment protects speech, by way of what can said, but, doesn't protect speech by way of how it said. Unfortunately some people have taken it ( the 1st amendment ) to say that speech is protected in every way, shape, and form including how it can be delivered. In fact the courts has decided that 1st amendment, and the 4th amendment, ( and is backed up by the 9th amendment ) imply the right to privacy, in certain areas and ways ( and in doing so prevent people from coming into your house or place of business, and telling you what they think ). The Constitution and the Bill of Rights is the basis for the rights of lawful citizens ( temporary and permanent ) and the standard by which laws are set, and with all three, they spell out the rights as I see them. "Any idgit" as you put it would just go with what he/she/they heard or were told, and not bother with actually looking up to see for them selves, if it was true or not. Sheeple was the term I think I read on this list. The U.S. would be a better place if everyone read what was posted, along with the case histories, then they would have a much better idea of what their Rights are, and would not just be lead around by the nose by those that would have them think otherwise. Lawyers and/or politicians love people that are ignorant as far as Rights are concerned. The world is an imperfect place, with imperfect people. As for paper matching reality, it is about the interaction of people with other people. Someone somehow is always going to wind up with the short end of the stick, and all that can be done is minimize the damage. That is why it is always open for interpretation and enhancement when necessary.
