IANAL, but I wasn't aware of a law prohibiting portscans. So neither you nor your customer is doing someting illegal.

Not sure about the Swiss specific situation, but nearly every
EU member state as a law that makes this possibly illegal.
Well, looks like it's portscanning "never ending thread" season again.
This is a never ending discussion, and each time somebody asks the
question "is portscanning illegal" on a mailing-list or newsgroup it
ends in "is there a moderator ?" or "how do I unsubscribe ?".

As far as I know, there is no case nor any judgement related to
portscanning activities (nor in the US, nor in the EU). Most of us
aren't lawyers: all the technical discussions and the usual
"real life" examples (read "if somebody tries to open every door of
my house - it's the same thing") aren't valid concepts nor relevant.

For the french speaking ones on the list, Thiebaut Devergranne [1] did
quite an extensive research through french law and cases. He came
to the conclusion that portscanning isn't illegal (at least in .fr).
