Ocean Ownership and Occupation: from Grotius to Blue Mud Bay

 

Hugo Grotius presented several arguments for the freedom of the seas which
have been enormously influential in legal theorizing and judgements about
ownership of the oceans. These arguments are described and evaluated mainly
from a contemporary perspective. I support the view that a free seas regime
has fostered problems such as overfishing and piracy and that the way
forward should be international sovereignty of the seas beyond 12 nautical
miles from shore. I try to show how we can get out of the grip of Grotius to
defend that view and in this quest I focus on his strongest argument
concerning occupation of the seas. I also detail how the spell of Grotius
has impeded judgements in Indigenous sea rights cases in Australia.
