*Professor Bernadette McSherry * Foundation Director of the Melbourne Social Equity Institute, University of Melbourne** * * *will speak on * * * *Legal Capacity, Mental Capacity and * *the Convention on the Rights of * *Persons with Disabilities* Time: 5.30 pm Venue: Australian Hearing Hub Building, Lecture Theatre One, Macquarie campus *(The lecture will be followed by a reception – all welcome)* Article 12 of the United Nations Convention on the Rights of Persons with Disabilities requires states parties to ensure that persons with disabilities “enjoy legal capacity on an equal basis with others in all aspects of life”. This presentation will explore what is meant by “legal capacity” and its constituent elements of legal standing and legal agency. It will outline recent research on what is meant by “support” to exercise legal capacity and how the traditional model of equating legal (in)capacity with mental (in)capacity is now being challenged in the light of the Convention. About Bernadette McSherry: Professor McSherry is the Foundation Director of the Melbourne Social Equity Institute, University of Melbourne, and Adjunct Professor, Faculty of Law, Monash University. She is an Australian Research Council Federation Fellow. She has honours degrees in Arts and Law, Masters of Law from the University of Melbourne, a PhD from York University, Canada and a Graduate Diploma in Psychology from Monash University. She is a Fellow of the Australian Academy of Social Sciences and a Fellow of the Australian Academy of Law.
