The problem is that highway=footway implies (in some people's eyes) that bicycle=no, and when the honest truth is that it's private land and the owner doesn't seem to care, you need to put something to modify the default.
bicycle=whatever seems to capture it well, but bicycle=tolerated or bicycle=accepted might translate better. Or maybe we need a separate bicycle:defacto tag.
