Looking through their data catalogue - http://data.nanaimo.ca/, I haven’t found any other statement that conflicts. What were/are you attempting to get from the aerial photos? Bing does not have street-level imagery for Nanaimo north of 49.14°N and east of 123.94°W, and all of the sources I can find for that imagery (Google, the City of Nanaimo itself) are walled off behind a layer of legal cowardice. - David E.
