Isn't it better to say access=private, and possibly foot=no
That way people know its private, keep out and its in both map reader and
landowners interest for the path to be on the map.

        It is precisely because of the possibility of incidents like this,
but where
        the landowner is right, that I really don't want paths like Nick's
in the OSM

Surely the only thing you do not want is the 'designation=public_footpath'
tag? - it is good to have the path in the database if it exists, because it
is useful for navigation.   I prefer to render all paths and tracks, even if
I am not supposed to walk on them because they are useful reference marks.
