5.0 MORAL RIGHTS
5.0 人格権
5.1 Moral rights. This section covers moral rights, including any
rights to be identified as the author of the Database or to object to
treatment that would otherwise prejudice the author’s honour and
reputation, or any other derogatory treatment:
a. For jurisdictions allowing waiver of moral rights, Licensor
waives all moral rights that Licensor may have in the Database to the
fullest extent possible by the law of the relevant jurisdiction under
Section 10.4;
b. If waiver of moral rights under Section 5.1 a in the relevant
jurisdiction is not possible, Licensor agrees not to assert any moral
rights over the Database and waives all claims in moral rights to the
fullest extent possible by the law of the relevant jurisdiction under
Section 10.4; and
c. For jurisdictions not allowing waiver or an agreement not to
assert moral rights under Section 5.1 a and b, the author may retain
their moral rights over certain aspects of the Database.
Please note that some jurisdictions do not allow for the waiver of
moral rights, and so moral rights may still subsist over the Database
in some jurisdictions.
5.1 人格権:
本項目は、人格権を対象とする。人格権には、本データベースの著者であるとして認定を受ける権利、又は著者の名誉及び評判を損なう取扱いその他の中傷的な取扱いに対して抗議する権利が含まれる。
a.
人格権の放棄を認める法域においては、許諾者は、本データベースに関して有するすべての人格権を、第10.4項に基づく法域の法が許容する最大限度において放棄する。
b.
該当する法域において、第5.1項aに基づく人格権の放棄が可能ではない場合、許諾者は、第10.4項に基づく法域の法が許容する最大限度において、本データベースに関して人格権の主張をしないこと、及び人格権に関するすべての請求を放棄することに、同意する。
c.
第5.1項a及びbに基づく人格権の放棄又は人格権の主張をしない合意を認めない法域においては、著作者は、本データベースのある面に関して人格権の保有を継続することができる。
ある法域では、人格権の放棄を認めておらず、そのような法域においては、本データベースに関して人格権が存続しうることに注意すべきである。

このあたりは専門家領域と思われるので以下は私見です。この条項は本来データベースの人格権を指していますが、データベース権が明確に定義されていない日本では、検索の手法などに独自の創意工夫が認められ、著作権の範囲でカバーされるものに対して適用すべきものと考えられます。よって「著作者人格権」との整合性を述べたものと解釈されます。その場合、（異論はありますが）日本では一般に著作者人格権は放棄できないとされていますが、それを行使しないという宣言は有効とされます。
従ってこの条項は日本では著作者人格権の不行使を明記したものと解すべきと思われます。
さらに言えば、ことOSM地理データベースに関しては個人的には事実情報しか無いので、この条項は該当しないのではないかと思っています。

6.0 FAIR DEALING, DATABASE EXCEPTIONS, AND OTHER RIGHTS NOT AFFECTED
6.0 公正取引、データベースに関する例外、影響を受けない他の権利
6.1 This License does not affect any rights that You or anyone else
may independently have under any applicable law to make any use of
this Database, including without limitation:
a. Exceptions to the Database Right including: Extraction of
Contents from non-electronic Databases for private purposes,
Extraction for purposes of illustration for teaching or scientific
research, and Extraction or Re-utilisation for public security or an
administrative or judicial procedure.
b. Fair dealing, fair use, or any other legally recognised
limitation or exception to infringement of copyright or other
applicable laws.
6.1 本ライセンスは、あなた又は他の者が適用法に基づいて本データベースの利用に関して独自に保有する権利に影響を与えない。これには、以下の項目などが含まれる。

6.2 This License does not affect any rights of lawful users to Extract
and Re-utilise insubstantial parts of the Contents, evaluated

including creating a Derivative Database (subject to other rights over
the Contents, see Section 2.4). The repeated and systematic Extraction
or Re-utilisation of insubstantial parts of the Contents may however
amount to the Extraction or Re-utilisation of a Substantial part of
the Contents.
6.2
本ライセンスは、ユーザーが、法律の範囲内で、あらゆる目的のために（派生データベースの作成を含む。）、コンテンツのわずかな部分（量的又は質的に評価する。）を抽出及び再利用する権利に影響を与えない（コンテンツに関する他の権利を条件とする。第2.4項を参照）。ただし、コンテンツのわずかな部分であっても、その部分の抽出又は再利用が反復的及び系統的に行われた場合には、コンテンツの相当部分の抽出又は再利用に該当する場合がある。

7.1 The Database is licensed by the Licensor “as is” and without any
warranty of any kind, either express, implied, or arising by statute,
custom, course of dealing, or trade usage. Licensor specifically
disclaims any and all implied warranties or conditions of title,
non-infringement, accuracy or completeness, the presence or absence of
errors, fitness for a particular purpose, merchantability, or
otherwise. Some jurisdictions do not allow the exclusion of implied
warranties, so this exclusion may not apply to You.
7.1
許諾者は、本データベースをそのままの状態で（現状有姿にて）許諾するとともに、明示的か、黙示的か、制定法によるか、慣習によるか、取引過程によるか、又は取引慣行によるかを問わず、いかなる種類の保証も行わない。許諾者は、所有権、権利の非侵害、正確性又は完全性、誤りの存在又は不存在、特定目的への適合性、商品性、その他の事項に関する黙示的なあらゆる保証又は条件を、明示的に否認する。ある法域では、黙示的保証の排除を認めていない法域においては、この保証の否認条項はあなたに適用されない。

8.0 LIMITATION OF LIABILITY

8.1 Subject to any liability that may not be excluded or limited by
law, the Licensor is not liable for, and expressly excludes, all
liability for loss or damage however and whenever caused to anyone by
any use under this License, whether by You or by anyone else, and
whether caused by any fault on the part of the Licensor or not. This
exclusion of liability includes, but is not limited to, any special,
incidental, consequential, punitive, or exemplary damages such as loss
of revenue, data, anticipated profits, and lost business. This
exclusion applies even if the Licensor has been advised of the
possibility of such damages.

8.2 If liability may not be excluded by law, it is limited to actual
and direct financial loss to the extent it is caused by proved
negligence on the part of the Licensor.
