I can see a problem with that idea. "I only infringed a little bit" is still infringing. "I only infringed a little bit, systematically, over a long period of time" is asking for trouble. To detect that a source is "protected" and still choose to infringe sounds like an exquisitely bad idea. Don't use sources without permission.
