How do you know that it's not in promiscuous mode?
NOTE: the fact that you don't see any packets other than those to and
from your machine doesn't prove that the card isn't in promiscuous mode
- you might be on a switched network (note that some hubs are "switching
hubs", so the fact that you're plugged into a hub doesn't mean you're
not on a switched network), or you might be plugged into a dual-speed
10Mb/100Mb hub.
"Why am I not seeing traffic for other machines with {packet sniffer
program X}?" is a frequently asked question, which is why it's in the
FAQ for one of those sniffers, Ethereal:

Perhaps it should go into the tcpdump FAQ as well.
On some operating systems, a message will be logged if a network
interface is put into promiscuous mode.
On what operating system are you trying to run your application?
