I don't want to speak for our moderator or put him in an uncomfortable position, but my recollection is that the last time there was a flurry of activity on the list to have this person removed for the same reasons here (actually I believe there were even more incendiary provocations then), he raised a similar "constitutional" issue then regarding such removal. It may be that the listowner received some advice from his institution that he should leave it alone then.
